課程概述 |
本課程將使用比較法之方法，讓同學探索台灣與美國身分法（family law）之異同，並與美國law school教師與學生實際交流。
9月14日週一17:30第一次上課，將進行課程導覽說明，決定日後上課時間，並分配前半部分導讀順序，欲修習本課程者務必到課，原則上不接受日後加選。
課程將分成兩部分進行，前半部（共5次，每次3節課）以中文為主，由授課教師指定台灣法及美國法的英文教材，每位同學須負責其中一篇的導讀，俾利在正式與美國同學合班上課前，對台灣及美國法的內容有概略認識。此部分的授課時間彈性，將在9/14與全體修課同學討論後決定，未必限定於週一10AB。
後半部（共5次，每次3節課），將與Fordham Law School的Clare Huntington教授與9位學生共同上課，採集中式英語教學，討論婚姻、家庭暴力、兒童虐待等議題。具體時間是：

課程目標 |
This course offers students the opportunity to compare the principles underlying modern family law in Taiwan and the United Sates. It is an aim of the course that family law should be seen in its wider social context and each student is required to explain his/her country's legal system to the partners from another country. In addition to the lectures, there will be group feedback sessions during the class.
On completion of this course, the student should be able to:
-Understanding of the relevant issues addressed by a family law system
-Awareness of the different alternatives to tackle family law problems with the assistance of comparative law
-Understanding of the functions of public policy and private law ordering in family law
-Ability to break down complex family law problems and come up with workable solutions

(2)課程前半部分不得缺席超過2次。
(3)課程後半部分必須全程到課，不得缺席。
違反上述任一規則者，不授與學分。
